Conflicto de competencia suscitado entre el Tribunal Superior de Medellín y el Juzgado Quinto Civil del Circuito de esa misma ciudad.
Para la Corte, el Tribunal mencionado tenía el deber constitucional de dar trámite a la solicitud de amparo, ya que no podía sustentar su falta de competencia en el alcance del artículo 1º del Decreto 1382 de 2000, toda vez que las reglas de reparto no generan conflictos de competencia en materia de tutela.
Con base en lo anterior, se dirime la controversia con la remisión del expediente a dicha autoridad, para que de forma inmediata lo tramite y profiera la decisión de fondo que corresponda.

- Primero. DEJAR SIN EFECTOS el auto de fecha 28 de julio de 2016 por medio del cual el Tribunal Superior del Distrito Judicial de Medellin se declaro sin competencia para conocer de la accion de tutela interpuesta por la senora Bertha Nelly Castaneda Hernandez.
- Segundo. REMITIR el expediente ICC 2554 al Tribunal Superior del Distrito Judicial de Medellin para que de tramite a la accion referida.
- Tercero. Por secretaria General, COMUNICAR al Juzgado
- Quinto. Civil del Circuito de Medellin y a las partes lo resuelto por esta Corporacion.
